Hyperkitchen LLC (d/b/a “Figmaker,” “Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it through compliance with this Privacy Policy (“Policy”).


This Policy describes the types of information we may collect from you or that you may provide when you visit and use our web application located at www.figmaker.com (the “Website”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.


This Policy applies only to our browser‑based web application. We do not offer native mobile apps at this time.


The Policy applies to information we collect:

  • On or through the Website (including the secure, logged‑in portion of the web app).

  • In email, text, chat, or other electronic messages between you and Figmaker relating to the Website.


It does not apply to information collected:

  • Offline or through any other means, including on any other website operated by Figmaker or any third party; or

  • By any third party, including through any application or content (such as advertising) that may link to or be accessible from the Website.


Please read this Policy carefully. If you do not agree with our practices, do not use the Website. By accessing or using the Website, you accept the terms of this Policy. We may revise the Policy from time to time (see Changes to Our Privacy Policy). Your continued use of the Website after we make changes constitutes acceptance of those changes.



2. Children Under the Age of 18


The Website is not intended for children under 18 years of age. No one under 18 may provide any personal information on or through the Website. We do not knowingly collect personal information from children under 18. If you are under 18, do not use the Website or provide any information on it. If we learn we have collected personal information from a child under 18 without verified parental consent, we will delete it. IP address, browser type, referring/exit pages, operating system, date/time stamps, clickstream data, and cookies (see Cookies below).

  • Directly from you – when you fill in forms, upload reference images, place an order, correspond with us, or respond to surveys.

  • Automatically – as you navigate the site (device and usage data via cookies, pixels, and similar technologies).



3.1 Information You Provide


Examples include:

  • Account registration details (email, password).

  • Reference images and descriptive attributes you upload so we can generate and manufacture your custom toy.

  • Shipping and payment details to fulfill your order.

  • Support inquiries or feedback.

As you interact with the Website we, or service providers acting on our behalf, may automatically collect:

We do not train third‑party AI models on your reference images. Images you upload are used solely to create your requested toy and for internal quality assurance unless you give explicit consent for additional uses (e.g., marketing).



5. Disclosure of Your Information


We may disclose information:

  • To service providers who help us run our business (e.g., payment processors, cloud hosting, shipping partners, contract toy manufacturers). They are bound by contractual obligations to keep information confidential and use it only for our authorized purposes.

  • To affiliates or subsidiaries under common ownership, consistent with this Policy.

  • In a business transfer, such as a merger, acquisition, or asset sale, where user information may be among transferred assets.

  • To comply with law – in response to lawful requests by public authorities, court orders, or legal processes.

  • To enforce our rights arising from contracts, or to protect the rights, property, or safety of Figmaker, our customers, or others.

  • With your consent – for any other purpose disclosed when you provide the information.


We may share aggregated or de‑identified information (which cannot reasonably identify you) without restriction.



6. Your Choices


  • Cookies & Tracking – Adjust browser settings to refuse cookies. Note that some functionality may break.

  • Marketing Emails – You can opt out of promotional emails via the unsubscribe link or by emailing support@figmaker.com. Administrative emails (order confirmations, legal notices) will still be sent.

  • Access, Correction, Deletion – You may:

    1. Access a copy of your personal data.

    2. Correct or update inaccurate data.

    3. Delete your data (“right to be forgotten”).

    4. Port your data in a machine‑readable format.


Requests can be made by logging into your account or emailing support@figmaker.com. We will respond within 45 days.



7. How Long We Keep Your Data


We retain personal information for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Reference images are retained no longer than 180 days after order completion unless you instruct us to store them for reorders or grant separate consent.



8. State Privacy Rights


Residents of California, Colorado, Connecticut, Utah, Virginia, and other states with privacy statutes may have additional rights, including the right to know, delete, correct, and opt out of certain data practices. To exercise these rights, email support@figmaker.com or write to the address below with the subject line “State Privacy Rights Request.”


California “Shine the Light” requests regarding disclosure of personal information for direct‑marketing purposes may also be sent to that address.



9. Data Security


We use industry‑standard safeguards to secure personal information, including:

  • Encryption of data in transit (TLS/SSL) and at rest for sensitive assets.

  • Secure, access‑controlled cloud infrastructure.

  • Regular security assessments and vulnerability management.


No system is 100 % secure. Transmission of information via the internet is at your own risk. You are responsible for keeping any account password confidential.



10. Changes to Our Privacy Policy


We post any changes on this page and update the “Last updated” date. If we make material changes, we will notify you via email or a prominent notice on the Website. You are responsible for ensuring we have an up‑to‑date, deliverable email address for you and for periodically reviewing this Policy.
